Disclaimers in Estate Planning

Disclaimers in estate planning refer to a legal provision that allows a beneficiary to refuse an inheritance or gift from a decedent’s estate. By executing a disclaimer, the beneficiary effectively relinquishes their right to receive the assets, which can then pass to alternative beneficiaries as designated by the decedent’s estate plan.

This can be beneficial for tax purposes or to avoid unintended consequences, such as disqualifying certain beneficiaries from receiving government benefits. For instance, if a parent leaves a significant inheritance to a child who is receiving needs-based assistance, that child might choose to disclaim their inheritance to preserve their eligibility for such benefits.

It is important to note that disclaimers must be made in writing and must adhere to specific legal requirements, including timeliness and the manner in which the disclaimer is executed, to be valid.
